Anatomy of a Gift Agreement

Participants in this session will dissect a gift agreement looking at vital parts such as enforcement provisions, naming terms, gift restrictions and fund management terms. Working through a gift agreement you will learn to draft agreements to meet you donor's wishes that can be administered by your charity for years to come.

About Our Speaker:

Reynolds T. Cafferata is a Partner at Rodriguez, Horii, Choi and Cafferata LLP. Mr. Cafferata's practice is concentrated in the area of non-profit, tax, estate and trust law.

He has experience advising charitable organizations and high net worth individuals regarding: planning complex charitable gifts and charitable trusts, creating and operating donor advised funds, private foundations and support organizations, creating policies for gift acceptance and risk management, unrelated business income taxes, and self-dealing and intermediate sanctions excises taxes and sophisticated estate planning and wealth transfer planning.

Mr. Cafferata also has considerable experience providing corporate fiduciaries guidance in the management of charitable trusts, as well as representing charities and fiduciaries in contested probates and judicial reformation of trusts. Also admitted to practice in Nevada.

Mr. Cafferata earned a juris doctor degree from the University of South California and a bachelor of arts from The George Washington University.

Ethical Fundraising with Senior Donors
David A. Kremer, Foundation Director, SantaFe Senior Living Foundation, Inc.

 
While there are national ethical fundraising standards, none specifically addresses issues that arise in dealing with older adults. As physical and mental abilities change, how can we be sure the aging donor fully understands the implications of the gift? Who has the responsibility to protect the potential donor’s interests? With aging baby boomers entering our communities, this is a very relevant topic. In this session, David Kremer will share and explain the in-depth research he's done on the topic, stimulate discussion and offer an original set of ethical standards for use specifically with seniors. It’s the first such set of senior-specific practices in the nation, but with your donors aging daily, it won’t be the last. You’ll learn how you and your organization can be among the first to demonstrate to seniors how you take the ethical high road, enriching and protecting the philanthropic interests of senior donors.

David A. Kremer, Foundation Director, SantaFe Senior Living Foundation, Inc.

About Our Speaker:

David Kremer is the Director of the SantaFe Senior Living Foundation in Florida. He's the fundraiser for the SantaFe Senior Living communities in Gainesville, Cutler Bay and Bonita Springs. He has been fundraising for 21 years, with 16 of those years spent helping seniors to realize their philanthropic dreams. He has served as President of the Milwaukee Planned Giving Council and a board member for the southeast Wisconsin Chapter of the Association of Fundraising Professionals. Kremer has given numerous presentations on planned giving topics and fundraising in a small shop. David has raised more than $24-million for the charities he has represented. He has an undergraduate degree in journalism and a master’s degree in organizational leadership.

Survey Says...Know Your Donors - It Pays to Ask

This presentation will provide answers to common questions planned giving professionals are asking about survey tools and how to put them to best use in growing their planned giving program. No matter your nonprofit’s size or sector you’ll gain valuable information on:

1)      Why should your organization survey? What should you expect from surveying your donors?

2)      Who should you be surveying and what’s the best format? How should you decide who’s in and who’s out?

3)      How often should you send surveys? Can you survey too much?

4)      How can the results of your organization’s survey impact your planned giving program?

 

 This session qualifies for CFRE credit.

Nathan Stelter is vice president of business development and marketing for The Stelter Company, a leading source for gift planning marketing for the nonprofit community. The Stelter Company, which was founded in 1962, currently partners with more than 1,400 organizations nationally with a staff of over 100 individuals.

While Nathan wears many hats at Stelter, his primary concentration and passion is overseeing Stelter's consulting and marketing teams and using his expertise to strategize with key accounts to develop distinct marketing solutions that meet their planned giving goals.

He has been quoted in Planned Giving Today, Advancing Philanthropy and other trade publications and is a past board member of the National Capital Gift Planning Council (Washington, DC) and current member of the Mid-Iowa Planned Giving Council.
